Terms and Conditions

Last updated: October 2026

These terms explain how our courses, qualifications and coaching work, what you can expect from us, and what we expect from you.

Our Services are education. How you use what you learn, on yourself or on anyone else, is your choice and your responsibility. Please read these terms before you buy. If anything is unclear, get in touch first.

1. Who we are

These terms are between you and The Living Well Collective Association (ABN [ABN]), trading as Somalign®. In these terms, "we", "us" and "our" mean The Living Well Collective Association, and "you" means the person buying, accessing or taking part in our Services.

These terms apply to everything we offer, whether online or in person, live or recorded, free or paid, including:

  • Somalign® Bowen Therapy: online courses, video lessons, yearly memberships, lifetime access and the Get Qualified pathway
  • Somalign® Bodywork: in-person and online training
  • Coaching and mentoring to help you grow your practice, business or personal brand
  • Workshops, demonstrations and live sessions
  • Our website somalign.io, our member area, and any community we run
  • Any future programs we release

Together we call these our Services.

2. Agreeing to these terms

By buying, enrolling, creating an account, ticking the box at checkout or using our Services, you confirm that:

  • you have read and understood these terms
  • you agree to be legally bound by them
  • you are at least 18 years old
  • the information you give us is true and up to date

If you do not agree with any part of these terms, please do not buy or use our Services. Our Privacy Policy also applies.

3. Your rights under Australian Consumer Law

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law, and similar laws in other countries. Nothing in these terms takes away those rights. Wherever these terms limit our responsibility, they do so only as far as the law allows.

4. Education only

All our Services are educational. They are not:

  • medical treatment or healthcare
  • physiotherapy, chiropractic or any registered allied health service
  • psychological, counselling or mental health therapy
  • financial, legal or business advice
  • a substitute for any licensed or regulated professional

We do not diagnose, treat, cure or prevent any medical, psychological or physical condition. Nothing we provide replaces advice, diagnosis or care from a qualified health professional.

Bronson Bertschinger teaches as a bodyworker, Bowen Therapy practitioner, educator and mentor. He is not a medical doctor, physiotherapist, psychologist or counsellor. Taking part in our Services does not create a doctor and patient, therapist and client, or any other clinical relationship with us.

5. Your health and your choices

Our Services include hands-on techniques, breathwork, nervous system work and emotional release. You agree that:

  • taking part is voluntary
  • you decide what is right for you, and you can stop or sit out at any time
  • you will check with your doctor before receiving or practising hands-on work if you have a medical condition, an injury, take medication, are pregnant, or have any health concern
  • emotional responses can come up during this work. Our training shows you how to hold them, but we do not provide counselling or mental health care. If you need that support, please see a qualified professional.
  • we do not supervise or monitor your health, and we do not give individual medical advice

Your acceptance of risk

Physical and emotional work carries some natural risk. You voluntarily accept responsibility for the risks, reactions and outcomes of your own participation, and of how you choose to apply what you learn. As far as the law allows, you release us from liability for outcomes that come from your own application of our material.

6. Working with clients

If you use anything you learn from us on another person, including family and friends, you agree that:

  • you are fully responsible for that person's treatment, safety and outcomes
  • you will get their informed consent, check for reasons not to treat, and refer them to a medical professional whenever needed
  • you will work only within your training and your legal scope of practice
  • you will hold any registration, licence and professional insurance required where you work, before treating paying clients
  • you will not describe Bowen Therapy, bodywork or Somalign® as a medical treatment, and you will not claim to cure or treat any disease or condition
  • you are responsible for your own advertising, claims, records and compliance with the law

We are not responsible for your practice, your clients, or anything you say or do in your work.

7. No guarantees

Results depend on many things outside our control, including your effort, experience, how you apply the material, and the laws and market where you live. We do not guarantee:

  • any health, physical, emotional or therapeutic outcome, for you or your clients
  • any income, business success, client numbers or referrals
  • professional recognition, membership of any association, or insurance cover
  • certification, unless you meet every requirement

Any examples, stories or testimonials we share are real experiences, not promises that you will get the same results.

8. Your account

  • Your account is for you alone. You must not share your login, give others access, or let anyone else watch the course through your account.
  • You are responsible for keeping your password safe and for everything that happens under your account.
  • If we reasonably believe an account is being shared or misused, we may suspend or close it without a refund.

9. Prices and payment

  • Prices are shown in US dollars and include any taxes we are required to charge. Your bank may add currency conversion or international fees. These are your responsibility.
  • Payments are processed by secure third party payment providers. We do not store your card details.
  • We may change our prices at any time. A price change will not affect anything you have already paid for. For yearly memberships, a new price applies from your next renewal, and we will tell you before it does.

10. Yearly membership

  • A yearly membership gives you access to the Somalign® Bowen Therapy online library for twelve months from the date you join.
  • It renews automatically each year at the current yearly price, using the payment method on your account, until you cancel.
  • We will send you a reminder email before each renewal.
  • You can cancel at any time from your account or by contacting us. Your access continues until the end of the year you have paid for. We do not give partial refunds for unused time.
  • If a renewal payment fails, we may pause your access until payment is made.

11. Lifetime access

Lifetime access is a single payment that gives you ongoing access to the Somalign® Bowen Therapy online library, including future updates we add to it.

"Lifetime" means the lifetime of the course and of our business. It is not tied to your lifetime or ours. If we ever stop offering the online course, or close the business, we will:

  • give you at least 30 days' notice by email, and
  • either let you download the course, or send you a downloadable copy of the entire course for your own personal use.

A downloaded copy is covered by the same personal licence in section 16. It must not be shared, uploaded or sold.

Past students

If you hold a qualification with us, or paid for lifetime access to Integrated Bowen Therapy, you are given lifetime access to Somalign® Bowen Therapy at no cost, on these terms. To claim it, get in touch and we will confirm your details.

12. Refunds

When you buy online access, you get the full library straight away. Because of this, we do not offer refunds if you change your mind once you have been given access.

This does not affect your rights under the Australian Consumer Law. If something we provide has a major problem, such as the course being unavailable for a long period or being significantly different from how we described it, you may be entitled to a refund or other remedy. Contact us and we will work with you to put it right.

For the Get Qualified pathway, coaching and in-person training, any refund or cancellation terms will be set out when you enrol or book. If none are set out, the paragraphs above apply.

13. Get Qualified and certification

  • To be certified, you must complete every requirement we set, including 25 documented treatments, the required video submissions and a final assessment. Requirements are explained when you enrol.
  • Paying for the Get Qualified pathway gives you access to the training, mentoring and assessment. It does not guarantee that you will be certified. Certification is issued when we are satisfied you have met the standard.
  • Time frames are a guide only. How long it takes depends on you.
  • Mentoring support runs for the period stated when you enrol. Any support beyond that is at our discretion, depends on your ongoing engagement and respectful communication, and can end at any time.
  • We may refuse or withdraw certification if you provide false information, submit work that is not your own, misrepresent your qualification, or act in a way that is unsafe or unprofessional.

Recognition and practising

  • Graduates can apply for membership and insurance with the International Institute for Complementary Therapists (IICT). Membership and insurance are decided by IICT, not by us, and we cannot guarantee them.
  • Somalign® qualifications are not government accredited qualifications and are not a medical or allied health registration.
  • Laws about practising complementary therapies differ between countries, states and regions. It is your responsibility to check what applies where you live and work.

14. Coaching

Coaching and mentoring help you think, plan and take action on your practice, business or personal brand. It is not financial, legal or accounting advice. You make your own business decisions and are responsible for them.

If you need to reschedule a booked session, please give us at least 24 hours' notice. Sessions missed without notice may not be rescheduled.

15. Live sessions and community

Live sessions may be recorded and shared with other students. If you do not want to appear, you can turn off your camera and use a display name.

You agree to communicate respectfully and honestly, keep appropriate personal and professional boundaries, and keep other students' personal information private. We may remove anyone who harasses others, promotes their own business without permission, or behaves in a way we reasonably consider unsafe or harmful.

16. Our content and your licence

All course videos, written material, worksheets, methods, frameworks, recordings and other content are owned by The Living Well Collective Association and protected by copyright. Somalign® is a registered trademark.

When you buy, we give you a personal, non-transferable licence to use the content for your own learning and your own practice. You may use what you learn to treat your clients. You must not:

  • copy, download, record, screenshot or share course content, except where we provide a download
  • upload, sell, resell or give away our content, or post it publicly
  • teach or train others in the Somalign® method, run courses based on our content, or create courses or materials derived from it
  • use the Somalign® name, logo or branding, or call yourself a Somalign® practitioner, unless you are certified and in good standing, and only in the way we approve

If you break this section, we may close your account without a refund and take further action to protect our work.

17. Your submissions

You keep ownership of the work you submit, such as case studies and videos. You give us permission to view, store and use it to assess your work and run the course. We will only use your work, name, image or testimonial publicly if you give us permission.

You are responsible for making sure anything you submit does not identify your clients, and that you have written consent from anyone who appears in a video.

18. Changes to our Services

We keep improving our courses. We may update, add, reorganise or replace content, and change how the Services are delivered, including the platform we use. We will not remove the core content you paid for without giving you something of similar value, unless section 11 applies.

Subject to section 3, our Services are provided as they are and as available. They rely on third party platforms, and we are not responsible for short outages, maintenance, or problems with your own internet or device.

19. Ending your access

We may suspend or close your account immediately if you seriously or repeatedly break these terms, misuse our content, or behave in a way that is abusive or unsafe. Where it is reasonable, we will give you a warning and a chance to fix the problem first. If we close your account because you broke these terms, you are not entitled to a refund.

20. Limits on our responsibility

As far as the law allows, we are not responsible for:

  • any injury, loss or damage arising from your participation, or from how you or anyone you treat apply the techniques and information in our Services
  • emotional responses or psychological discomfort that arise during or after the work
  • claims made by your clients, or anything arising from your practice
  • indirect or consequential loss, such as lost income, clients, opportunity, reputation or data

Where our liability cannot be excluded, it is limited, at our choice, to supplying the Service again or refunding what you paid for that Service.

None of this limits rights you have under the Australian Consumer Law that cannot be excluded, and none of it limits liability for our own negligence where the law does not allow that.

21. Your responsibility to us

You agree to cover us for any claim, loss or cost we face because you broke these terms, misused our content, or because of treatments or advice you gave to others, except to the extent we caused the problem.

22. Changes to these terms

We may update these terms from time to time. The latest version will always be on this page, with the date it was last updated. If we make a significant change that affects you, we will let you know by email. If you keep using our Services after a change, the updated terms apply. Changes do not apply to anything you bought before the change, unless the law requires it or the change benefits you.

23. Disputes and governing law

If something goes wrong, please contact us first. Most problems can be sorted out with a conversation. If we cannot resolve it within 30 days, we both agree to try mediation in Victoria, Australia, before going to court, except where urgent action is needed.

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If you are a consumer living in another country, you keep any protections the law of your country gives you. You are responsible for complying with local laws, licensing and insurance requirements where you live and work.

24. General

  • These terms, together with our Privacy Policy and any enrolment terms for a specific program, are the whole agreement between you and us.
  • If any part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • You cannot transfer your account or these terms to anyone else. We may transfer them if our business is sold or restructured.
