Somalign®
Privacy Policy
This policy explains what personal information we collect, why we collect it, how we look after it, and the choices you have.
The short version: we only collect what we need to teach you, support you and run our business. We never sell your information. You can ask to see, correct or delete it at any time.
1. Who we are
Somalign® is operated by The Living Well Collective Association (ABN [ABN]), based in Australia. In this policy, "we", "us" and "our" mean The Living Well Collective Association, trading as Somalign.
This policy covers:
- Somalign® Bowen Therapy, including online courses, video lessons, memberships and practitioner qualifications
- Somalign® Bodywork, including in-person and online training
- Coaching and mentoring to help you grow your practice, business or personal brand
- Our website somalign.io, our member area, our emails, and any online community or live sessions we run
Together we call these our Services. For people in the UK and EU, we are the data controller of the personal information described in this policy.
2. The laws we follow
We handle personal information in line with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. Where they apply to you, we also follow the UK GDPR and Data Protection Act 2018, the EU General Data Protection Regulation, and applicable privacy laws in the United States, Canada, New Zealand and other countries where our students live.
3. What we collect
Information you give us
- Your name, email address, phone number and country
- Account details for our member area
- Details about your training, such as your experience, goals and the qualifications you hold or are working towards
- Coursework and assessments, including case studies, treatment logs and practice videos you submit
- Recordings of live sessions and mentoring calls, where you take part and we have told you the session is recorded
- Information about your practice or business that you share during coaching
- Messages, form submissions, survey answers and feedback
- Testimonials or reviews, only with your permission
Health information
If you receive a treatment from us, or take part in hands-on training where you are treated, we may ask about your health so we can work with you safely. This may include injuries, conditions, medications and how you are feeling. Health information is sensitive, so we only collect it with your consent, only when we need it, and we keep it confidential.
Information about your clients
Some qualifications ask you to submit case studies or treatment notes. Please remove anything that identifies your clients, such as names, dates of birth and contact details, before you send them to us. If a submission includes a video of a client, you must have that person's written consent for us to view it for assessment. We only use this material to assess your work.
Information collected automatically
When you visit our website or member area, we may collect technical information such as your IP address, browser and device type, the pages you visit, and the date and time of your visit. We use this to keep the site secure, fix problems and understand what is useful.
Payment information
Payments are handled by secure third party payment processors. We do not see or store your full card details. We keep a record of what you bought, when, and how much you paid.
4. How we collect it
We collect information directly from you when you buy a course, create an account, fill in a form, book a session, email us or take part in training. We also collect some information automatically through cookies, as explained below. If someone else gives us information about you, such as a practitioner referring you, we will handle it under this policy.
5. How we use it
- To give you access to your course, member area and qualification pathway
- To assess your work and issue certificates
- To deliver coaching, mentoring and live sessions
- To process payments and manage memberships, including renewals
- To answer your questions and give you support
- To send you important information about your account or purchase
- To send you news, teaching and offers, if you have agreed to hear from us
- To improve our courses, content and website
- To keep our Services secure and prevent misuse
- To meet our legal, tax and accounting obligations
Our legal reasons (UK and EU)
If you are in the UK or EU, we rely on these lawful bases:
- Contract: to provide the course, coaching or service you have paid for
- Consent: for marketing emails, testimonials, health information and non-essential cookies. You can withdraw consent at any time.
- Legitimate interests: to run, protect and improve our business in ways you would reasonably expect
- Legal obligation: to keep records we are required by law to keep
6. Emails and marketing
We will only send you marketing emails if you have agreed to receive them or have bought from us before. Every marketing email has an unsubscribe link. Unsubscribing stops marketing, but we may still send you messages about your account or a purchase.
7. Cookies and tracking
We use cookies and similar technologies to make our website work, remember your preferences, and understand how people use the site. Some cookies come from the tools we use, such as analytics and advertising platforms. You can block or delete cookies in your browser settings. Some parts of the site may not work properly without them.
8. Who we share it with
We never sell or rent your personal information. We only share it when we need to, with:
- Service providers who help us run our business, such as website and membership hosting, email delivery, payment processing, video hosting, video calls and cloud storage. They can only use your information to provide their service to us.
- Professional bodies, such as the International Institute for Complementary Therapists (IICT), if you ask us to confirm your qualification
- Professional advisers, such as our accountant or lawyer, where needed
- Authorities, if the law requires it, or to protect someone's safety
- A new owner, if our business or part of it is sold or restructured. They would have to protect your information in the same way.
We will not share your health information with anyone without your consent, unless the law requires it.
9. Sending information overseas
We are based in Australia, and our students live around the world. Some of the service providers we use store information outside Australia, most commonly in the United States, and also in the United Kingdom, the European Union and other countries.
When we send information overseas, we take reasonable steps to make sure it is protected to a standard similar to Australian law. For information from the UK or EU, we rely on recognised safeguards such as Standard Contractual Clauses or an adequacy decision.
10. How long we keep it
We keep your information only as long as we need it:
- Course and account records: while your access is active, and for lifetime students, for as long as you have access
- Qualification and assessment records: for as long as we may need to confirm your qualification, which may be many years
- Financial records: at least seven years, as required by Australian tax law
- Health information: only as long as needed for your treatment or training and any legal requirements
- Marketing: until you unsubscribe
When we no longer need information, we delete it or make it anonymous.
11. Keeping it safe
We use reasonable technical and practical measures to protect your information, including secure, password protected systems and limiting who can access it. No system is completely secure, so we cannot guarantee security. If a data breach is likely to cause you serious harm, we will tell you and the relevant regulator as the law requires.
12. Your rights
You can ask us to:
- Give you a copy of the personal information we hold about you
- Correct information that is wrong or out of date
- Delete your information, unless we need to keep it by law
- Stop or limit how we use your information
- Send your information to you or another provider in a common format
- Stop sending you marketing
If you are in the UK or EU, you also have the right to object to processing based on our legitimate interests, and to withdraw consent at any time.
To make a request, contact us using the details below. We will reply within 30 days. We may need to confirm your identity first. There is no charge for most requests.
13. Complaints
If you are unhappy with how we have handled your information, please contact us first so we can try to put it right. We will respond within 30 days.
If you are not satisfied, you can complain to the privacy regulator where you live:
- Australia: Office of the Australian Information Commissioner, oaic.gov.au
- United Kingdom: Information Commissioner's Office, ico.org.uk
- European Union: the data protection authority in your country
- New Zealand: Office of the Privacy Commissioner, privacy.org.nz
14. Age
Our Services are for people aged 18 and over. We do not knowingly collect information from anyone under 18. If you believe a young person has given us their information, please contact us and we will delete it.
15. Other websites
Our website and emails may link to other websites, such as YouTube or social media. We are not responsible for how those sites handle your information, so please read their privacy policies.
16. Changes to this policy
We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated. If we make a significant change, we will let you know by email or through the member area.
